1. Definitions

1.1 In these Terms and Conditions, "you" refers to the person who buys a car from MY LHD CAR FRANCE Ltd. "We," "us," or "our" refers to MY LHD CAR FRANCE Ltd.

1.2 These Terms and Conditions apply to all car purchases ordered through our website (www.my-lhd.co.uk), by telephone, or via email.

1.3 The car is sold to you by MY LHD CAR FRANCE Ltd, which is authorized to accept orders and receive payment on our behalf. The order becomes effective 14 days after the contract is signed and the terms and conditions are accepted. If it's agreed that the service starts immediately after the deposit payment, you will not be able to cancel the contract.

2. Price and Price Variations

2.1 The **purchase price** is the total amount you pay for the car, including number plates, optional equipment, accessories, and any extended warranty specified in your order. Foreign registration is only included if stated in the contract. Cars are sold **tax-free**; EU registration costs or local tax costs are not included unless otherwise specified. To prevent double taxation, we recommend clearing all taxes in the country where the car will be permanently imported and registered.

2.2 We may adjust the purchase price due to changes in car tax rates, exchange rates, road fund license fees, and/or Value Added Tax (VAT) between the date we accept your order and the date we inform you the car is ready for delivery. The price does not include registration or local tax costs. MY LHD CAR FRANCE will not be responsible for extra costs due to changes in the laws or import regulations of the country where the car is imported.

2.3 We may adjust the agreed part-exchange price based on any increase or decrease in the vehicle's market valuation or its actual condition when delivered to us, provided this adjustment occurs within 8 days of the original information being provided.

2.4 For **cars ordered for import**, the price advertised on our website and in quotations includes delivery to our premises in the United Kingdom or France. This also includes registration costs in these countries (Carte Grise only for France, but not pollution or CO2 tax). For **stock cars or special offers**, delivery and registration costs are not included in the advertised price.

3. Payment Terms

3.1 You must pay the purchase price (less any deposit paid and the value of any part-exchange vehicle) in Pounds Sterling (or agreed currency) via electronic fund transfer (BACS or CHAPS) to MY LHD CAR FRANCE Ltd as soon as possible, or within 14 days of our acceptance of your order.

4. Delivery and Vehicle Condition

4.1 When you place an order, you can choose to have the vehicle delivered to an address in mainland Great Britain or another agreed location within 30 days of your order, unless otherwise agreed.

4.2 Your car will be driven by a company driver unless otherwise stated. You have the option to have the car delivered on a transporter, and we will advise you of the prices for different delivery methods. This also applies to European or Worldwide delivery.

4.3 You can change your chosen delivery method up to 7 working days before the scheduled delivery date, provided you pay the relevant delivery charges upon delivery.

4.4 If you request delivery to an address in mainland Great Britain or another agreed destination, the car may not be perfectly clean and may show some wear and tear from the journey. We will not be liable for such wear and tear unless it was caused by our negligence. The odometer mileage will reflect the journey's distance. Second-hand vehicles may have minor wear and tear (e.g., scratches on bodywork or bumper) consistent with the car's age and mileage.

4.5 We will aim to deliver the vehicle by the date specified in our confirmation of acceptance of your order, but delivery time is not of the essence. We will not be liable for any delay in delivery or for any losses (including loss of enjoyment, use, and profit), costs, damages, charges, or expenses caused directly or indirectly by any delivery delay.

5. Termination

5.1 We may terminate the contract if any of the following occur and, if the breach can be fixed, you have not done so within 14 days of receiving a written notice from us:

  • 5.1.1 We reasonably believe the contract was based on a typographical or arithmetical error (e.g., in the purchase price or part-exchange valuation).
  • 5.1.2 You fail to pay the purchase price and any other amounts due before or when the car is available for delivery.
  • 5.1.3 You fail to collect the car within 14 days of the agreed collection date.
  • 5.1.4 You do not agree on a delivery date and nominate an address within 14 days of us notifying you that the vehicle is available for delivery or collection.
  • 5.1.5 You are unable or refuse to accept delivery at your nominated address on the agreed date and did not provide us with more than five working days' notice.
  • 5.1.6 You breach any of these Terms and Conditions.

5.2 If we give you notice under clause 5.1, we may store the car ourselves or have it stored by a third party on terms we deem appropriate. The reasonable costs of such storage and any additional transportation will be paid by you until we deliver the car to you or terminate the contract.

6. Your Right to Cancel

6.1 The Consumer Contracts Regulations 2013 grant you the right to cancel the sales agency service contract at any time up to the end of the **14th working day** beginning the day after you signed the contract or paid the deposit. Working days exclude weekends and bank holidays. You may cancel the supply of goods contract at any time up to the end of the **14th working day** beginning the day you received the car.

6.2 If you wish to cancel the contract, you must notify us in writing with a reasonable explanation for the cancellation. Please send this via email first, and then to our physical address, which will be confirmed in our email response.

6.3 If you cancel the contract in accordance with these Terms and Conditions after the vehicle has been delivered, it must be returned to our UK address at your own cost.

6.4 When returning or allowing collection of the car, you must provide us with all keys, the V5 registration document (or any other registration documents you received), and all optional equipment, accessories, and other items supplied with the car. The car's mileage must not exceed **200 km** from the mileage recorded at delivery; otherwise, we will charge one pound per kilometer. We will not accept returns or part-exchanges for accident-damaged cars, regardless of whether they have been repaired.

7. Cancellation Process

7.1 The contract is binding between MY LHD CAR FRANCE Ltd and the buyer, not the supplier. If you cancel the contract after the 14-day cooling-off period following your order, we will charge a cancellation fee of up to **£850** or **20% of the total order value**, whichever is greater.

7.2 If you cancel the contract within 14 days following the car's delivery, this charge will not apply. However, you must take good care of the car until it is returned to us and agree to any necessary arrangements for us to collect it if required.

7.3 We will return all sums you paid for the canceled car, minus any deductions under Condition 7.1, any amounts paid to third parties, and any sums related to services already provided by the cancellation date, within 30 days of receiving your written cancellation instructions.

7.4 If we have taken possession of a part-exchange vehicle from you when you cancel the contract, we may either return the part-exchange vehicle to you or pay you a sum equal to its agreed valuation.

7.5 If you purchased the car through a finance company and cancel the contract, your cancellation notice will also cancel the agreement between us and the finance company, as well as the agreement between you and the finance company.

7.6 You will not be entitled to cancel the contract if:

  • 7.6.1 The car has suffered any damage not caused by us, unless we agree to accept the return of the car and adjust the refund to cover repair costs and any reduction in the car's value.
  • 7.6.2 You are unable or refuse to return the car to us or permit us to collect it as per Condition 7.3.
  • 7.6.3 The car has been customized to your specifications or clearly personalized (e.g., through registration, specific features, or other modifications).
  • 7.6.4 You fail to take reasonable care of the car, including increasing the mileage by more than 50 miles/km from the reading recorded on the car handover checklist provided at delivery.

8. Limitation of Liability

8.1 Nothing in these Terms and Conditions affects or excludes your statutory rights as a consumer or any other rights that cannot be legally excluded. All other terms implied by law are excluded to the fullest extent permitted.

8.2 We will not be liable for any loss of profit, anticipated savings, loss of enjoyment, or any other consequential loss.

9. Privacy, Terms of Use, and Complaints

9.1 By placing an order, you agree to be bound by our Terms and Conditions, which can be viewed by clicking on the "Terms and Conditions" link on our website's homepage and reviewing the Visitor Agreement.

9.2 We will collect personal information such as your name, address, telephone number, and email address. We will not share this information with any outside company or persons.

9.3 We will keep your personal information in a secure environment in accordance with the provisions of Principle Seven of the Data Protection Act 1998.

9.4 By providing us with your personal information, you consent to its use as described in our Privacy Policy and agree to be included on our direct marketing mailing lists. If you do not wish to receive further marketing information, wish to access, update, or correct any inaccuracies in the personal information we hold about you, or have any other comments or complaints regarding the contract, please write to us or email us at complaint@my-lhd.co.uk.

10. General

10.1 We may inform you verbally that the car is available for delivery, but any other required notices related to the contract must be in writing and delivered by hand or prepaid first-class post (or airmail for notices sent from outside the United Kingdom). We will send notices to the postal address you provide when placing an order or to another address you notify us of in writing. Notices sent to us must be addressed to MY LHD CAR FRANCE. Notices will be considered received at the time of delivery (if hand-delivered), two working days after posting if sent by pre-paid first-class post, or seven working days after posting if sent by airmail. Please check our dispute page to resolve any issues arising before or after the order.

10.2 The contract is personal to you, and you may not assign or transfer it to any third party without our prior written consent.

10.3 We can transfer our rights under the contract to a third party, but nothing in these Terms and Conditions grants any person who is not a party to the contract any benefit or right to enforce any of the contract terms.

10.4 Except as stated in Condition 1.4, nothing in these Terms and Conditions creates a partnership or agency between us and My Left Hand Drive Car Ltd, or authorizes either party to act as an agent or hold itself out as an agent for the other. Neither we nor MY LHD CAR FRANCE Ltd have the authority to act in the name of, on behalf of, or otherwise to bind the other in any way.

10.5 The display of cars on the website and the provision of any quotation is not an offer to sell you a car. If you wish to buy a car, you must place an order, which we may accept or refuse. We reserve the right to ask you to pay a deposit. If we refuse to accept your order, we are not obligated to provide a reason. If we do accept your order, the contract will, if you have applied for credit to buy the car, be conditional upon your credit application being accepted.

10.6 All drawings, photographs, illustrations, descriptions, and advertising material on our website are published only to give you an approximate idea of the cars for sale and do not form part of the contract between you and us.

10.7 Your order and the information on the contract are governed by and interpreted in accordance with **English law**.

10.8 The **English courts** have jurisdiction to hear disputes between us.
